Westover Division - Detectives investigating an Officer Involved Shooting in the 1500 block of West Boulevard

A Superior Court judge has granted a media request authorizing the Charlotte-Mecklenburg Police Department to release body-worn camera footage of the January 16, 2019, officer involved shooting incident involving Michael Kelley.

Due to the graphic nature of the videos, discretion is strongly advised.

The CMPD has traditionally transmitted the relevant portion of video recordings to the courts, based on the petitioners' request.  Moving forward, the CMPD's policy will involve transmitting all body-worn camera video of the petitioned incident to the presiding Superior Court jduge along with appropriate redaction recommendations.   

    
INCIDENT SUMMARY:
On January 16, 2019, the Charlotte-Mecklenburg Police Department investigated two separate armed robberies in the Westover Division, in relatively close proximity to each other. The first robbery occurred at approximately 1:40 p.m. in the 300 block of Freeland Lane. During that robbery, the suspect entered a church and asked for money. When a man inside the church declined to give the suspect money, the suspect pulled out a box cutter, cut the victim and then proceeded to take the keys to his Infiniti and the suspect left the area. The report number for this robbery is 2019-0116-135600.

A short time later, a suspect matching the description in the prior incident, robbed the Family Dollar Store in the 460 block of West Tyvola Road. The suspect in this robbery left the store in an Infiniti. The store employees reported that they believed the suspect was armed with a gun during the commission of the robbery. The report number for this robbery is 2019-0116-135701.

At approximately 2:40 p.m., a Westover Division patrol officer located the unoccupied stolen Infiniti in a shopping center in the 1500 block of West Boulevard. Based on the description given of the suspect in both robberies, officers believed the same suspect committed both robberies.

Officers were circulating the area when K-9 Officer Timothy Kiefer observed the suspect standing on the sidewalk near the location where the Infiniti was found. Officer Kiefer advised over the radio that he had located the suspect and pulled into the parking lot in the 1500 block of West Boulevard. Officer Kiefer exited his patrol vehicle and observed Mr. Kelley step out from behind a dumpster. Officer Kiefer gave Mr. Kelley several loud verbal commands; however, Mr. Kelley began rapidly moving toward Officer Kiefer, holding in his right hand what Officer Kiefer thought was either a gun or a knife. Officer Kiefer let his K-9, Baco, out of the vehicle and continued giving commands to Mr. Kelley. Mr. Kelley continued progressing quickly toward Officer Kiefer. Officer Kiefer discharged his firearm several times, striking Mr. Kelley. Mr. Kelley was transported to Atrium Health where he was pronounced deceased a short time later.

The Charlotte-Mecklenburg Police Department’s Homicide Unit concluded their investigation and turned all of the evidence over to the Mecklenburg County District Attorney’s Office for their review. On March 26, 2019, the District Attorney determined that Officer Kiefer faced an imminent threat of great bodily harm or death and did not seek any charges related to the death of Mr. Kelley. Case Update: Thursday, January 17, 2019,

Detectives with the Charlotte-Mecklenburg Police Department's Homicide Unit have identified the male subject as Michael Daniel Kelley, DOB: 05/08/1986.  Mr. Kelley was pronounced deceased at Atrium Health.  His family has been notified of his death.

The member of the Charlotte-Mecklenburg Police Department who fired his weapon has been identified as Officer Timothy Kiefer.  Officer Kiefer was hired on January 22, 2007, and is assigned to the Special Operations Division as a K-9 handler.  As is standard procedure with any officer involved shooting, the Internal Affairs Bureau will conduct a separate but parallel investigation to determine whether CMPD policies and procedures were adhered to during the course of the incident.  Per department protocol, the officer has been placed on paid Administrative Leave.

Information gathered in this investigation indicated that Officer Kiefer observed Mr. Kelley on foot in the 1500 block of West Boulevard.  Officer Kiefer attempted to make contact with Mr. Kelley in the parking lot of 1520 West Boulevard.  Officer Kiefer exited his vehicle and immediately began to give loud, repeated, verbal commands to Mr. Kelley.  Mr. Kelley immediately began to walk quickly toward Officer Kiefer, rapidly closing the distance.  Officer Kiefer opened the rear door of his marked police vehicle and his K-9 exited the vehicle.  Officer Kiefer gave commands to his K-9 to engage Mr. Kelley.  Mr. Kelley began to sprint toward Officer Kiefer.  Officer Kiefer continued to give loud, repeated, verbal commands to Mr. Kelley; however, Mr. Kelley ignored the commands and continued to rapidly advance toward Officer Kiefer.  Officer Kiefer fired his service weapon, striking Mr. Kelley. 

Crime Scene Technicians processed the scene and recovered a knife at the scene of the incident.

This is an active and ongoing investigation.  As additional information develops it will be released by CMPD Public Affairs.

Wednesday, January 16, 2019,

Detectives with the Charlotte-Mecklenburg Police Department's Homicide Unit are conducting an officer involved shooting investigation that occurred in the 1500 block of West Boulevard in the Westover Division.

On Wednesday, January 16, 2019, at approximately 4:30 p.m., a CMPD K9 officer located a man who was on foot, fitting the description of a suspect wanted in two armed robberies that occurred earlier in the day.

The officer exited his marked police vehicle and made contact with the subject. During the encounter, the officer perceived an imminent deadly threat and subsequently fired his weapon striking the man.

Medic responded to the scene and transported the subject to Atrium Health where he was pronounced deceased a short time later.

Crime Scene Technicians processed the scene and recovered a knife at the scene of the incident.

Detectives canvassed the area and are interviewing potential witnesses.  Representatives with the Mecklenburg County District Attorney's Homicide Prosecution Team and Operations Command responded to the scene.

Below is the sequence of robberies that preceded the shooting.

At approximately 1:40 p.m., a male suspect entered a church in the 300 block of Freeland Lane and asked for money. When a man inside declined to give the suspect money, the victim stated the suspect pulled out a box cutter, cut the victim and took his car keys before stealing the victim's Infiniti. A short time later, a suspect matching the description in the prior incident, robbed the Family Dollar Store in the 4600 block of W. Tyvola Road and left in an Infiniti. The store employees reported they believed the suspect was armed with a gun during the commission of the robbery. No injuries were reported.  (KBCOPS report number 20190116-135701)

CMPD Communications broadcast the robbery suspect's description from both incidents city-wide advising officers to be on the lookout for the listed suspect and vehicle.
