On Sunday, March 31st, 2019 at approximately 1:24 a.m., Officers with the Charlotte-Mecklenburg Police Department's Steele Creek Division responded to the 9400 block of S. Tryon Street in reference to a motor vehicle vs pedestrian crash call for service. Upon their arrival, the officers located an unresponsive male laying in the roadway. The driver of a 2004 Nissan Xterra was also on scene. Medic responded to the crash scene and transported the pedestrian, Nabil Donald Lambert-Smith, to Atrium Health's Carolinas Medical Center but was later pronounced deceased. The driver of the Nissan Xterra, Robert Barnard Eakin, did not sustain injury during the crash. Detectives with The Major Crash Unit and the D.W.I. Task Force responded to conduct an investigation.
The preliminary investigation indicates that the Nissan Xterra was traveling south on S. Tryon Street and the pedestrian was crossing or standing in the south bound lanes. The pedestrian was struck by the Nissan outside of a crosswalk. The pedestrian was wearing dark clothing and the Nissan was not speeding. The driver of the Nissan Xterra was screened for impairment on scene by a member of the DWI Task Force and there were no signs of impairment. It is unknown if the pedestrian was impaired and test results are pending. Next of Kin has been notified.
