***UPDATE*** Metro Division - Detectives investigating an Officer Involved Shooting in the 2600 block of Beatties Ford Road

A Superior Court judge has granted a media request authorizing the Charlotte-Mecklenburg Police Department to release the entire body-worn camera footage of the March 25, 2019, officer involved shooting incident involving Danquirs Franklin.

Due to the graphic nature of the videos, discretion is strongly advised.

In addition, earlier today the Charlotte-Mecklenburg Police Department's Homicide Unit turned over all of the evidence to the Mecklenburg County District Attorney's Office for their review.  

This is an active and ongoing investigation. As additional information develops it will be released by CMPD Public Affairs.

A Superior Court judge has granted a media request authorizing the Charlotte-Mecklenburg Police Department to release body-worn camera footage of the March 25, 2019, officer involved shooting incident involving Danquirs Franklin.

Due to the graphic nature of the videos, discretion is strongly advised.

The video included in this release meets the burden of compelling public interest as stated in the petitioners request for release.  This is the only body-worn camera video relevant to the incident and as approved by the Superior Court judge.  Below is the portion of  the incident from March 25, 2019:

INCIDENT SUMMARY:
On March 25, 2019, the Charlotte-Mecklenburg Police Department received two separate 911 calls, both in reference to an armed individual who entered the business at 2601 Beatties Ford Road. The first caller frantically said she needed police quickly because the individual entered the store, walked behind the counter with a gun and was pointing it at an employee. The second caller frantically said she needed police because an individual had approached her vehicle while she was waiting for food in the parking lot of the business and pulled out a gun. Both callers independently called 911 between 9:00 am and 9:02 am.

An assault with a deadly weapon with no injury call for service was entered at 9:01 am. Metro Division Officer Wende Kerl and Metro Division Officer Larry Deal were dispatched to the call for service at 9:02 am and they both arrived at 9:04 am. A description of the individual was given to both officers over the radio, and in addition, our Real Time Crime Center was monitoring the call and directed the officers over the radio to his exact location. Both Officers exited their vehicle in the parking lot and observed an individual, later identified as Danquirs Franklin, squatting next to an open front passenger door of a vehicle that was parked in a parking space at the business. Both Officers gave several commands to Mr. Franklin to drop the gun. A short time later, Officer Kerl perceived an imminent, deadly threat and subsequently fired her department issued firearm two times, striking Mr. Franklin. He was transported to Atrium Health where he was pronounced deceased a short time later.

The Charlotte-Mecklenburg Police Department’s Homicide Unit is currently investigating this matter. At the conclusion of their investigation, all of the evidence will be turned over to the Mecklenburg County District Attorney’s Office for their review.

The Charlotte-Mecklenburg Police Department is releasing two different 911 calls related to this incident, a timeline of events, as well as the identities of the male subject and the officer involved. 

The Charlotte-Mecklenburg Police Department Communications Division received two different 911 calls related to this incident.  The calls have been attached to this email and will also be posted to the CMPD Newsroom shortly.

The recordings have been edited, as required by state statute, to alter each caller's voice and remove any personal information such as name, address, and telephone number.  Below is a timeline on when CMPD received the 911 calls and when the Officers were dispatched, were enroute and arrived at the scene:

First call to 911 – 9:00:38 to 9:02:57

Second call to 911 – 9:01:40 to 9:04:17

Officers dispatched to the call at 9:02:18 and 9:02:26

Officers enroute to the call at 9:03:12 and 9:03:32

Officers arrived to the call at 9:04:52 and 9:04:53

Detectives with the Charlotte-Mecklenburg Police Department's Homicide Unit have identified the male subject in this case as Danquirs Napoleon Franklin, DOB: 02/19/1992 .  He was pronounced deceased at Atrium Health Carolinas Medical Center.  His family has been notified of his death. 

The member of the Charlotte-Mecklenburg Police Department who fired her weapon has been identified as Officer Wende Kerl.  Officer Kerl was hired on April 19, 1995, and is assigned to the Metro Division.  As is standard procedure with any officer involved shooting, the Internal Affairs Bureau will conduct a separate but parallel investigation to determine whether CMPD policies and procedures were adhered to during the course of the incident.  Per department protocol, the officer has been placed on paid Administrative Leave.

Monday, March 25, 2019

Detectives with the Charlotte-Mecklenburg Police Department's Homicide Unit are conducting an officer-involved shooting investigation in the 2600 block of Beatties Ford Road in the Metro Division.

On Monday, March, 25, 2019, at approximately 9 a.m., officers were called to reports of an armed man in a business. Officers engaged the man in the parking lot and repeatedly ordered him to drop his gun. During the encounter, one of the officers perceived a lethal threat and fired a service weapon, striking the man.

Medic transported him to Atrium Health's Carolinas Medical Center, where he has since been pronounced deceased. The subject's name is temporarily being withheld pending appropriate family notification.

The officer's name is temporarily being withheld pending appropriate family notification of the incident.

As is standard procedure with any officer involved shooting, the Internal Affairs Bureau will conduct a separate but parallel investigation to determine whether CMPD policies and procedures were adhered to during the incident. The officer will be placed on paid administrative leave, which is standard policy whenever an officer discharges a service weapon.
