The pedestrian in this case has been identified as Demarcus Lamont Fleming, B/M, DOB: 04/13/1997. His next of kin has been notified of his death. Anyone with information about this case can call Crime Stoppers or Detective. A. J. Oberer at 704-432-2169.
Wednesday, October 4, 2018,
On October 4, 2018 at 6:39 a.m. the victim was walking westbound on the side of the road in the 8200 block of Independence Boulevard. The victim was walking with the direction of traffic and out of the travel lanes. As he was walking, a 2009 Honda Pilot was traveling westbound towards Charlotte in the right lane. Evidence at the scene showed the Honda Pilot drifted to the right and out of the travel lane where it struck the pedestrian. The driver of the vehicle immediately stopped and the passenger called 911. At the time of the crash, it was dark and the roadway was not lighted. The Charlotte-Mecklenburg Police Department, Charlotte Fire Department, and Medic responded to the scene. Medic pronounced the pedestrian deceased upon arrival. There were no other injuries to persons involved. The Major Crash Investigation Unit responded to the scene and is conducting the investigation.
Based on the evidence at the scene including witness statements and roadway evidence, the driver was charged with Misdemeanor Death by Motor Vehicle and Failure to maintain a lane of travel.
A member of the DWI Task Force responded to the scene and determined there was no evidence of impairment of the driver. Speed is not a factor in this case. This is an ongoing investigation and any witnesses are encouraged to call Crime Stoppers or Detective Oberer with the Major Crash Unit at 704-432-2169.
The name of the victim is being withheld pending family notification.
