The Charlotte-Mecklenburg Police Department created the Authorization to Act as Agent to deal with the problem of trespassers on commercial property after business hours or on vacant property when no one was authorized to be on that property. The Authorization is a tool for police to eject or arrest persons who have no right to be on certain property without the necessity of the owner's presence. This authority is NOT for property which is partially occupied, such as an apartment complex or part of a duplex or triplex. It also is NOT for commercial property which stays open to the public for 24 hours (where there are public telephones, ATM's, etc.). In order for the Authorization to be enforced, the property must be posted with "No Trespassing" signs which are clearly visible. The wording of the signs is up to you. (If you prefer, "no trespassing" signs can be purchased at most hardware stores.) Additionally, we must be advised of specific hours during which absolutely no one is permitted on the property. The owner or manager must indicate these hours on the application AND ON THE NO TRESPASSING SIGNS. The agency status will remain in effect for one year unless terminated by you prior to that date. A new form must be filled out if ownership changes and/or to renew the authorization for an additional year.
